These terms are the agreement between you and Creative App Solutions, LLC for Turbo Arena, our car soccer game for iPhone and Android, and for the online services the game uses: our account server (the lobby) and our match servers. Please read them together with our Privacy Policy, which explains what we collect and why.
The short version: play fair, pick a clean name and treat other players with respect. Anyone can play offline, and accounts and online play are for players 13 and over. Turbo Arena is free to play and has no ads; on iPhone it sells optional packs of cosmetic items (section 11). You can delete your account at any time. Sections 13 and 14 limit our responsibility, and section 17 explains how disputes are handled.
Turbo Arena is made and published by Creative App Solutions, LLC, a North Carolina limited liability company ("we," "us" or "our"). We also run the servers the game uses online. You can reach us at abraham@casolutions.app.
You accept these terms by tapping AGREE & PLAY when the app first starts, on the screen that links to these terms and our Privacy Policy. If your account has not accepted the current version of these terms, the app asks you once more (I AGREE) before you play online, and online play, display names and friends wait until you agree. If you are under 18, or under the age of majority where you live if that is higher, a parent or guardian needs to accept these terms for you (section 3). You can read these terms and the Privacy Policy at any time under SETTINGS > INFO in the app.
You can play Turbo Arena offline against bots without an account. The app itself is licensed to you under section 8, or, if you got it from Apple's App Store, under Apple's Standard EULA (section 12.1).
If you do not agree to these terms, please do not create an account or use the online services.
Turbo Arena is for players of all ages offline: anyone can play against bots without an account.
To create an account or play online, you must be at least 13. If you are 13 or older but under 18, or under the age of majority where you live if that is higher, please read these terms with your parent or legal guardian. By letting you create an account, they agree to these terms on your behalf and are responsible for how you use the online services.
We may limit some online features for younger players, or start them with more private settings, where the law or the app stores require it. If we do, the Privacy Policy will explain how before it happens.
The first time the app starts, it asks for your month and year of birth. Players under 13 can play everything offline but cannot sign in, create an account or play online. Players 13 to 17 start with more private settings: other players cannot find them by display name unless they turn on FIND ME BY NAME. Section 14 of the Privacy Policy has the details, including what to do if you gave the wrong birth month or year by mistake.
We will not enforce these terms against a minor where the law does not allow it. For example, where a state law requires a parent's consent through the app store, we will not enforce them against a minor unless we have verified that consent through the app store.
Parents and guardians: if you think your child is using an account without your permission, or you want to know what an account holds or have it deleted, email us.
Your display name is shown to other players in matches (over your car, on the scoreboard and on the results), in parties, in friends lists and friend requests, and to players who look you up by name to send a friend request. It does not need to be your real name, and we suggest it is not. You can change it once a day.
Names must follow the rules in section 6. Our name filter refuses some names automatically, and we may reset or remove a name that breaks these terms, pretends to be someone else, or that we are asked to remove for a good legal reason, such as a trademark complaint. If we reset your name, you can pick a new one. When an account is deleted, its name becomes free for other players.
We have zero tolerance for objectionable content and abusive players. When you use Turbo Arena, you agree not to:
If you find a bug that gives an advantage, or a security problem, please tell us instead of using it.
Your tools. You can REPORT and BLOCK any friend and anyone who sends you a friend request, under FRIENDS in the app, and any other player you meet in an online match, from the match results or the scoreboard (players who left early are under PLAYERS WHO LEFT). A report gives a reason: name, cheating, harassment or other. A report from a match can also carry a short note. Blocking someone ends your friendship and any requests between you, stops their requests reaching you and stops them seeing whether you are online, and in matches their name shows to you as BLOCKED PLAYER.
Email. To report a player you cannot report in the app, or anything you believe is illegal, email us with their display name, what happened, and when. For something you believe is illegal, please also tell us why.
How we check. Every display name goes through an automatic filter that checks it against a list of blocked words and reserved names, including look-alike spellings. Apart from that filter and automatic limits, such as how many friend requests, name searches and reports an account can make in an hour or a day, and at most five signed-in devices per account (a sixth sign-in ends the oldest session), we make no automatic decisions about accounts. A person at Creative App Solutions reads every report, and we aim to act on reports of objectionable content within 24 hours.
What we may do. Depending on how serious a problem is and whether it has happened before, we may reset a display name, suspend an account from online play for a time, or close it for good. We may act without warning when a problem is serious. We keep reports as the Privacy Policy describes, and we may pass information to the authorities when the law requires it or when we believe in good faith that someone's safety is at risk.
Suspensions and name resets. While your account is suspended, you cannot sign in, play online or use friends, and the app tells you until when and how to reach us. You can still sign out and delete your account, but deleting it does not end the suspension: the same Apple or Google sign-in cannot make a new account until the suspension would have ended. A display name we reset cannot be used again, by you or by anyone else.
Appeals. Your account has no email address, so we may not be able to tell you first. If you think we got something wrong, email us: a person will look at it again and tell you the outcome and our reasons.
Turbo Arena is licensed to you, not sold. As long as you follow these terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to install and use the app on phones you own or control, for your own entertainment and not for commercial purposes. If you got the app from Apple's App Store, Apple's Standard EULA governs that license, as section 12.1 explains.
We and our licensors own the game, including its code, servers, cars, arenas, art, sounds, names and logos. Apart from this license, these terms give you no rights in them. Unless the law allows it despite this, you may not copy, sell, rent or distribute the app, modify, decompile or reverse engineer it, remove its notices, or build or run unofficial servers or versions of it.
Videos and streams. You are welcome to share screenshots, videos and streams of your own gameplay, including on channels that earn money from ads, as long as you do not suggest that we endorse you and do not offer the game's art or sounds on their own.
Open-source software. Some parts of the app are open-source software under their own licenses, for example the Godot Engine under the MIT license. Those licenses govern those parts. The app lists them, with their notices, under SETTINGS > INFO > LICENSES.
Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
The only things you write in the game are your display name and any note you add to a report from a match; quick chat sends only phrases from the app's own list. You keep whatever rights you have in what you write. You give us a worldwide, non-exclusive, royalty-free license to store and copy it, to show your display name to other players, and to review and moderate it, only to run and protect the game and for as long as the Privacy Policy says we keep it. You confirm that you have the right to use it and that it follows these terms.
Turbo Arena is free to download and play, and it shows no ads.
Purchases. On iPhone, the app's STORE sells optional packs of cosmetic items for your car, such as boosts, toppers, goal explosions and demolition sounds. These rules apply to them:
Ads. We may add ads in the future. Before a version of the app with ads is released, we will update these terms and our Privacy Policy and tell you in the app. If we do, at least these rules will apply:
The app store you got Turbo Arena from applies its own terms to your download. Sign in with Apple, Sign in with Google and purchases through the App Store run under Apple's and Google's own terms. You must also follow any other company's terms that apply when you use the game, such as your mobile data plan.
If you got the app from Apple's App Store, you and we also agree that:
Apple's standard Licensed Application End User License Agreement (the "Standard EULA") governs your license to use the app. These terms govern our online services (your account, online play and friends) and everything else between you and us. If the two conflict, the Standard EULA prevails for your license to the app, and these terms prevail for the online services.
Google Play's terms apply to your download. Google is not a party to these terms and is not responsible for the game.
TURBO ARENA AND OUR ONLINE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not promise that the game will be free of bugs, uninterrupted or secure, or that your account, display name or friends list will never be lost.
We are not responsible for what other players do, though we act on reports as section 7 describes.
Some states do not allow some of these disclaimers. If you live in one of them, you keep the rights your state's law gives consumers, and nothing in these terms takes them away.
To the fullest extent the law allows:
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
If you break these terms or the law while using the game and someone makes a claim against us because of it, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees, to the extent the law allows.
You can stop playing at any time, and you can delete your account in the app or by email.
We may suspend or close your account, or stop providing the online services to you, if you seriously or repeatedly break these terms, if the law requires it, if it is needed to protect other players or the game, or if we stop running online play (section 10). If we close your account, you lose it along with its display name, friends, friend requests and blocks, as the Privacy Policy describes. Packs you bought stay with your Apple Account (section 11).
Sections 8 (apart from the license itself), 9, and 13 to 19 continue to apply after these terms end.
Talk to us first. If you have a problem with the game or these terms, please email us with your display name, your platform, what went wrong and what you would like us to do. We will try to sort it out within 30 days. This does not stop you from going to a small claims court, and it does not affect any deadline the law gives you.
Governing law. These terms, and any dispute about them or the game, are governed by the laws of the State of North Carolina and applicable U.S. federal law, without regard to conflict of laws rules.
Courts. Any dispute will be decided by the state or federal courts located in North Carolina, and you and we agree to their jurisdiction, unless the law where you live gives you the right to bring the claim in your local courts. Either of us may instead bring a claim in a small claims court that has jurisdiction over it.
We may update these terms, for example when the game gets new features or the law changes. We will post the new version on this page and update the "Last updated" date at the top. If a change materially affects your rights, we will tell you in the app before it takes effect and, where the law requires it, ask you to agree again. A change does not apply to a dispute that arose before it. If you do not agree to a change, you can stop using the online services and delete your account.
